These Terms of Service govern all purchases made through AlocasiaBoutique.com.

By placing an order on this website, you agree to the terms set out below.

1. Scope

These Terms apply to all orders placed through the online store operated under the brand Alocasia Boutique.

2. Formation of Contract

The presentation of products in the online store does not constitute a legally binding offer but an invitation to place an order.

By completing the checkout process, the customer submits a binding offer to purchase the selected products.

After submitting an order, the customer receives an automatic confirmation email acknowledging receipt. This confirmation does not constitute acceptance of the order.

A binding contract is formed only when:

the order is expressly confirmed,
the goods are dispatched, or
a shipping confirmation is sent.

Alocasia Boutique reserves the right to refuse or cancel any order at its discretion.

Orders may be delivered in partial shipments if necessary.

3. Prices and Payment

All prices are listed in euros (€) and include applicable VAT where required by law.

Shipping costs are calculated separately and clearly displayed during checkout.

Payment must be completed at the time of purchase using the payment methods available in the Shopify checkout system.

Alocasia Boutique reserves the right to suspend or cancel orders in the event of payment issues.

4. Shipping and Delivery

Delivery is made to the address provided by the customer during checkout.

Detailed shipping conditions are outlined in the Shipping Policy and form an integral part of these Terms.

Delivery times are estimates and may vary due to circumstances beyond our control, including courier delays or weather conditions.

5. Delivery Responsibility

The customer is responsible for ensuring availability at the delivery address.

Live plants must be received promptly. Alocasia Boutique cannot be held responsible for damage resulting from delayed collection, incorrect address details, or exposure to extreme temperatures after delivery.

6. Packaging and Transport

All plants are packaged carefully to minimize transit stress.

If a parcel arrives visibly damaged, the customer should document the condition immediately and retain all packaging materials.

Failure to document transport damage upon delivery may limit the ability to process claims.

7. Live Plants

Plants are natural, living organisms. Variations in size, shape, coloration and variegation are normal and are not considered defects.

All plants are carefully inspected before shipment and are healthy at the time of dispatch.

Please note that plants are continuously growing and changing. As a result, the plant you receive may differ slightly from the photos displayed on the website. Natural growth processes may include the development of new leaves, the loss of older leaves, changes in size, or variations in coloration.

Due to environmental and genetic factors, variegation intensity, pattern distribution and future growth behavior cannot be guaranteed.

8. Reporting Issues

Any claims regarding damage or serious condition issues must be submitted within 48 hours of delivery.

The claim must include:

Clear photos
An unboxing video (strongly recommended)
Description of the issue

Without proper documentation, claims may not be accepted.

9. Right of Withdrawal

In accordance with EU regulations, perishable goods such as live plants are exempt from the right of withdrawal.

Returns or exchanges of live plants are therefore generally not possible unless an error has occurred on our part.

10. Limitation of Liability

Alocasia Boutique shall not be liable for damage resulting from improper care, unsuitable environmental conditions, repotting stress, or failure to follow care guidelines after delivery.

11. Data Protection

Personal data is processed in accordance with our Privacy Policy, available on this website.

12. Applicable Law

These Terms are governed by the laws of Spain and applicable European Union regulations, excluding the UN Convention on Contracts for the International Sale of Goods.

If any provision of these Terms is found to be invalid, the remaining provisions shall remain unaffected.

For customers who are businesses or legal entities, the place of jurisdiction shall be Spain.
